Seattle lawmakers side with Uber, taxi drivers
The Seattle City Council took the first swing at the nation's ballooning freelance "gig" economy, approving a measure that would give app-based drivers and others in the jurisdiction the ability to collectively bargain over their wages and working conditions.
Under the proposal, drivers would have the ability to come together to choose a nonprofit organization to represent them. Once authorized, the organization could engage in collective bargaining on the drivers’ behalf. The new law would apply to all taxi drivers, for-hire drivers and drivers for app-based dispatch companies, such as Uber and Lyft.
Drivers and community supporters celebrated the bill’s passage, calling it a turning point toward greater protections for workers in a changing economic landscape. Peter Kuel, an Uber driver and member of the leadership council of the App-Based Drivers Association, said:
Because of their disputed status as independent contractors, however, for-hire drivers don't have the ability to unionize through a traditional National Labor Relations Board (NLRB) election process, and they aren't covered under Seattle's wage theft, sick leave or new $15 an hour minimum wage law.
John Scearcy, Secretary-Treasurer of Local 117, is hopeful the legislation -- if signed by the mayor -- will go a long way towards making things more fair:
Legal challenges to the NLRB ruling have already been filed and are expected if the Seattle measure becomes law. But these rulings are just more proof that when workers are Teamster Strong, America is Stronger!

We’re looking for fairness and the ability to earn a living wage.Seattle app-based drivers as well as traditional taxi drivers are already aligned with Teamsters Local 117.Taxi drivers formed the Western Washington Taxicab Operators Association in 2012. In 2013, drivers for app-based dispatch companies formed the App-Based Drivers Association.

All workers, no matter where they work or the nature of their work, deserve the opportunity to have a voice. The Universal Declaration of Human Rights identifies the right of workers to bargain collectively as a fundamental human right. Now these workers have that right.Figuring out the future of organizing as the gig economy continues to grow in the U.S. is a major challenge for workers. The Teamsters' victory earlier this year in the "Browning-Ferris" case decided by the NLRB was seen by many as an opportunity to expand union representation among millions of workers nationwide who previously were misclassified as independent contractors.

Hoffa joins port truck drivers on SoCal picket line

Hoffa walked the picket line during the second day of an unfair labor practice walkout against Pacific 9 Transportation and XPO Logistics, which have continually engaged in misclassification, retaliation, harassment and intimidation against their workers for having filed wage theft claims with the California Labor Commissioner's Division of Labor Standards Enforcement.
Hoffa said:
We have already organized hundreds of port drivers. We have a lot of work to do. Yesterday I sat down with 40 drivers – and they told me how there is no dignity, favoritism, no seniority, and that it has got to end. Most of America doesn’t understand what independent contractors are. Wage theft ends here today.

After all, misclassification doesn't just hurt the workers and their families, it effects all Americans through pervasive and wide scale tax fraud that robs schools, roads and public safety services of billions in essential resources.
The plight of port truck drivers is being heard, however. Earlier this month, Local 848 member Alex Paz attended a White House forum and spoke out against wage theft. He told attendees how before he was hired as a full-time worker, he often didn't earn enough to support his family.

Finally, some are getting the message on wages
What is a middle-class wage? Evidently, the United Automobile Workers (UAW) have taken a significant step towards defining it in their latest contract agreement with Fiat Chrysler.
The deal would raise the salaries of both veteran workers and newer workers up towards $30 an hour over a four- and eight-year period, respectively. Those salaries, in turn, will set a standard that even non-union foreign carmakers in the U.S. will feel pressured to follow, as The New York Times stated. In short, the effort shows the power organized labor. But it also shows the importance of efforts like the Teamsters' "Let's Get America Working" campaign. As the Times points out:
Even some franchisers, like one who owns a handful of Qdoba Mexican Grill restaurants in northern Colorado, is raises wages. Steve Laurer told the Greeley Tribune the move will not only help his workers, but his businesses as well.
It is good to see that some employers are getting the message. But there is still a long ways to go for most workers. Misclassification, as the Times mentioned, is a huge problem for port truck drivers and workers in other industries like construction as well. Too many companies are still interested in pocketing all the profits at the expense of their employees.
As we enter the 2016 political campaign season, candidates and elected officials need to listen to the voices of everyday Americans. They are being treated unfairly and have had enough. Those who choose to oppose them do so at their own peril.

Talking wage theft at the White House

I talked about what it is like to be a misclassified driver, what it is like to go home without a paycheck. What it's like to be charged by a company to rent your truck, for registration, parking, tires, insurance. And what it's like to go home with a negative paycheck and tell your wife, 'I don't have any money to sustain the family.'Paz, a member of Local 848, took part in a panel on organizing during the White House Summit on Worker Voice. He said he and other participants were encouraged that President Obama and administration members issued their support for unions during the event.
But there is a lot of hard work that goes into increasing union membership. Paz said he got involved with the port campaign in June 2013, and since then has seen a dramatic improvement in conditions at the ports of Los Angeles and Long Beach. That said, wage theft and unfair treatment remains a reality for all too many port truck drivers not only in Southern California where Paz resides, but across the country as well.
Nick Weiner, port campaign director for the Teamsters, said it is time more companies recognize the tide is turning against them:
Alex's opportunity to speak at the White House yesterday is an indication of the incredible progress and transformation we've been able to achieve collective as drivers over the last couple of years and accomplish the impossible. No one believed that trucking companies at the port would acknowledge that their drivers are employees. But today their are 500 Teamster port drives at the ports of Los Angeles and Long Beach.

The professional driver, a husband and father to two young children, now works for Eco Flow Transportation and is in the process of negotiating his first union contract with the company and committee of co-workers.
Paz, who is based in Los Angeles, was selected among nominees from around the country to lend his voice to the summit. The event will focus on how workers can make their voices heard in the workplace, and energize a new generation of Americans to come together and recognize the potential power of their voice at work.
At the summit, Paz will be joined by Teamsters General President Jim Hoffa and International Vice President Rome Aloise, along with union leaders, workers and employers from around the country.
President Obama will deliver opening remarks and take part in a town hall at the summit.

NLRB win for Teamsters is a victory for millions
The Teamsters were at the forefront of a significant victory for workers last week. And the decision by the National Labor Relations Board (NLRB) could provide a voice for millions of additional Americans.
As part of the NLRB's "joint employer" ruling, employers that rely on temporary or contracted workers can now be held accountable for the actions of the firms they use to oversee workers.The ruling will have a significant impact on how franchisers like McDonald's and other mostly low-income employers do business.
Teamsters General President Jim Hoffa said:
The Teamsters have repeatedly fought against employers shifting responsibility of their workforce, whether through misclassification at companies like FedEx, at our nation's ports or through the use of staffing agencies in the food processing industry at companies like Taylor Farms.
It's time for corporations to realize that mistreatment in the workplace is not acceptable. The NLRB's decision will give more workers the ability to stand up for their rights and to be able to rely on unions to advocate for their jobs. That's real justice for everyday Americans.

This decision will make a tremendous difference for workers' rights on the job. Employers will no longer be able to shift responsibility for their workers and hide behind loopholes to prevent workers from organizing or engaging in collective bargaining. This is a victory for workers across America.The NLRB ruling resulted from a 2013 case brought by Local 350 in Daly City, Calif. against Browning-Ferris, a waste management company that is owned by Republic Services -- the second-largest waste services company in the U.S. The union maintained that Republic had control over wage and working conditions for its workers employed through Leadpoint Services, a staffing agency, and counted as a joint employer with that agency.

New bill would stand up for workers against misclassification
The issue of misclassification, in which workers are treated as independent contractors by their employers even though they have no independence when it comes to their work, is gaining more attention.
For years, the Teamsters have stood with port truck drivers in Southern California, Georgia and elsewhere who have been repeatedly shortchanged on wages, fair labor standards, health and safety protections and unemployment and workers' compensation benefits. But now policymakers are beginning to take notice as well.
First, the Department of Labor earlier this month issued an interpretation calling misclassification one of the most serious problems confronting workers on the job. And this afternoon, several members of Congress rolled out legislation that would prohibit the practice as a way for companies to avoid paying their fair share of taxes.
Rep. Frederica Wilson (D-Fla.), a chief sponsor of the bill in the House, said it is in the best interest of workers and businesses to address this issue:
In addition, the bill would make it a violation of the Fair Labor Standards Act to "discharge or discriminate" against a worker for questioning their classification. Employers could face fines of up to $5,000 for each willful violation.
Sen. Bob Casey (D-Pa.), a sponsor of companion legislation in the Senate, said lawmakers need to stand up to these corporate lawbreakers:

Misclassification cheats hard-working Americans out of federally guaranteed labor rights and benefits, such as overtime pay, minimum wage, and family and medical leave. Misclassification cheats law-abiding businesses out of a level playing field. Misclassification cheats the American economy out of billions of dollars in tax revenues, putting a strain on already stressed programs like Medicare and Social Security.The measure, "The Payroll Fraud Prevention Act," requires all workers to be accurately classified as employees or non-employees, and mandates that workers be given a written notice of their classification. It also creates a presumption that when a employer fails to address the issue, the worker is considered an employee.
